⚠️ Important Notice

PolyFly is experimental beta software. By using this platform, you acknowledge that you may lose some or all of the funds you deposit. Never trade more than you can afford to lose. This is not financial advice.

1. Acceptance of Terms

By accessing or using PolyFly ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. PolyFly reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

2. Nature of the Platform

PolyFly is a decentralized prediction market protocol built on the Hedera Hashgraph network. The Platform allows users to create and trade on the outcomes of future events. PolyFly is not a broker, exchange, custodian, or financial institution. The Platform provides software tools that interact with smart contracts deployed on a public blockchain.

3. Not Financial Advice

Nothing on the Platform constitutes financial, investment, legal, or tax advice. Prediction market shares are not securities, derivatives, or financial instruments under any jurisdiction's regulations. You should consult with qualified professionals before making any financial decisions. Past performance of any market or trader does not indicate future results.

4. Beta Software

PolyFly is currently in beta. The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. Beta software may contain bugs, errors, or vulnerabilities that could result in loss of funds. You acknowledge that you use the Platform at your own risk and that PolyFly shall not be liable for any damages arising from your use of the Platform.

5. User Responsibilities

You are solely responsible for: (a) maintaining the security of your wallet and private keys; (b) all transactions made through your wallet; (c) ensuring that your use of the Platform complies with all applicable laws in your jurisdiction; (d) any tax obligations arising from your trading activity; (e) evaluating the risks of any market before trading. PolyFly cannot recover lost funds, reverse transactions, or reset wallet access.

6. Market Creation and Resolution

Users who create markets are responsible for defining clear resolution criteria and resolving markets in good faith. PolyFly does not guarantee the accuracy, timeliness, or fairness of any market resolution. In the event of a disputed resolution, the Platform may implement a community governance process to determine the outcome. PolyFly reserves the right to void markets that violate community guidelines.

7. Prohibited Activities

You agree not to: (a) use the Platform for money laundering or terrorist financing; (b) manipulate markets through wash trading or collusion; (c) create markets designed to incentivize illegal activity; (d) attempt to exploit or attack the smart contracts or infrastructure; (e) use automated systems to gain unfair advantages without disclosure; (f) impersonate other users or entities.

8. Geographic Restrictions

Prediction markets may be prohibited or restricted in certain jurisdictions. It is your sole responsibility to determine whether your participation is lawful in your jurisdiction. PolyFly makes no representation that the Platform is appropriate or available for use in any particular jurisdiction. Users from restricted jurisdictions access the Platform at their own risk.

9. Limitation of Liability

To the maximum extent permitted by law, PolyFly, its contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of funds, loss of profits, or loss of data, arising from your use of the Platform. Our total liability shall not exceed the amount of fees you have paid to the Platform in the preceding 12 months.

10. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be addressed through the Platform's community governance mechanism. If the dispute cannot be resolved through governance, parties agree to attempt resolution through good-faith negotiation. These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

11. Intellectual Property

PolyFly is open-source software. The source code is available under its respective license. The PolyFly name, logo, and brand elements are the property of the Fly ecosystem. User-generated content (market questions, descriptions) remains the property of their creators but is licensed to the Platform for display and operation.

12. Termination

PolyFly may restrict or terminate access to the Platform at any time, for any reason, without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including limitations of liability, disclaimers, and dispute resolution.
